§ 1 Scope of application, customer information

The following general terms and conditions regulate the contractual relationship between rock-o-rama.net Shop and the consumers and entrepreneurs who purchase goods via our shop. We shall not recognise any terms and conditions that conflict with or deviate from our terms and conditions. The contractual language is German.

§ 2 Conclusion of contract

The offers on the Internet represent a non-binding invitation to you to purchase goods.

After entering your data and by clicking the order button, you submit a binding offer to conclude a purchase contract. However, you can also place a binding order by telephone, fax or e-mail.

With the confirmation of receipt sent immediately by e-mail or fax, the acceptance of your offer is also declared and the purchase contract is thus concluded. In the case of an order placed by telephone, the purchase contract is concluded if we accept your offer immediately. If the offer is not accepted immediately, you are no longer bound by it.

§ 3 Customer information: Storage of your order data

Your order with details of the concluded contract (e.g. type of product, price etc.) will be stored by us. We will send you the general terms and conditions, but you can also access the general terms and conditions at any time after conclusion of the contract via our website.

As a registered customer, you can access your past orders via the customer log-in area (Login).

§ 4 Customer information: Correction notice

You can correct your entries at any time before placing the order by pressing the delete key. We will inform you about further correction options on the way through the ordering process. You can also exit the ordering process completely at any time by closing the browser window.

§ 5 Right of withdrawal and returns

5.1 Right of withdrawal and exceptions

You can cancel your order in accordance with the statutory right of cancellation without giving any reasons. In addition to the statutory right of withdrawal, we grant you a voluntary right of withdrawal extended to a total of 30 days for those articles that are also subject to the statutory right of withdrawal. The same conditions apply as for the statutory right of withdrawal, but extended to 30 days.

Attention:

The right of withdrawal does not apply to the delivery of audio or video recordings (e.g. CDs, LPs, DVDs) or software (e.g. games); to the delivery of tickets for events of any kind (e.g. concerts); to the delivery of goods which are not subject to the statutory right of withdrawal. concerts); for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by you is decisive or which are clearly tailored to your personal needs; for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed (e.g. piercings, contact lenses).

5.2 Return costs

We do not bear any return costs if you return items to us within the scope of the right of withdrawal.

5.3 Processing the return

In order to exercise the right of withdrawal, you must make a corresponding declaration. You can do this, for example, by using the cancellation form and sending it to us.

You must bear the costs of a return shipment yourself and send the articles back with a parcel service of your choice. In the event of a justified complaint or if you exercise your right of cancellation, we will subsequently reimburse you for the charges incurred.

5.4 Return information

You are expressly not obliged to give reasons, but we would nevertheless like to ask you to note or state the reason for the cancellation.

§ 6 Retention of title

The object of purchase remains our property until full payment has been made.

§ 7 Warranty

The warranty is governed by the statutory provisions.

§ 8 Limitation of liability

We exclude liability for slightly negligent breaches of duty insofar as these do not relate to material contractual duties, damage resulting from injury to life, limb or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to provide you with ownership of it. Furthermore, we must provide you with the item free of material defects and defects of title.
